1. Acceptance of Terms

By downloading, accessing, or using TungMax AI, you confirm that you have read, understood, and agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the app.

2. Description of the Service

TungMax AI is an entertainment and self-improvement planning app that provides:

• Camera and photo-based face scanning.
• ARKit-supported face tracking overlays on supported Apple devices.
• AI-generated face ratings, feature scores, verdicts, and commentary.
• Daily looksmax routines, streaks, progress history, and scan history.
• Referral codes, seal keys, and subscription-gated unlock flows.

3. Eligibility

You must be at least 13 years old to use TungMax AI. If you are under the age of majority where you live, you may use the app only with permission from a parent or legal guardian.

4. AI Verdicts and No Professional Advice

TungMax AI uses automated AI systems to generate ratings, feature scores, commentary, and routine ideas. These outputs are subjective, may be inaccurate, and are provided for entertainment and general self-improvement planning only. They are not medical, psychological, dermatological, nutritional, fitness, or professional advice.

Do not rely on TungMax AI to diagnose, treat, or evaluate any health, body image, mental health, or medical condition. If you have concerns about your health, appearance, skin, diet, exercise, or mental wellbeing, consult a qualified professional.

5. Photos, ARKit, and Your Responsibility

You are responsible for the photos you capture, select, upload, or submit for analysis. You may submit only photos that you own or have permission to use. Do not submit images of other people without their consent.

On supported devices, TungMax AI uses ARKit face tracking to help guide capture. ARKit availability and performance depend on your device, iOS version, lighting, camera access, and Apple platform behavior.

6. Subscriptions, Purchases, and Billing

TungMax AI may offer subscription-based or paid access to features, including verdict unlocks or premium flows. Purchases are billed through your Apple App Store account. Payment is charged at purchase confirmation and subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.

You can manage or cancel subscriptions in your Apple ID subscription settings. Cancellations take effect at the end of the current billing period. Refund requests are handled by Apple according to Apple policies.

7. Referrals and Seal Keys

TungMax AI may allow users to share referral codes and earn seal keys or other unlocks. Referral rewards may require valid code redemption and may be limited to one accepted code per device identity. We may reject, reverse, or modify referral rewards if we detect abuse, fraud, self-referral, automation, duplicate activity, or technical error.

8. Acceptable Use

You agree not to:

• Use the app for illegal, harmful, abusive, deceptive, or unauthorized purposes.
• Submit photos you do not have the right to use.
• Harass, shame, threaten, or harm another person using app outputs.
• Attempt to manipulate subscriptions, unlocks, referral codes, seal keys, scan results, or app storage.
• Reverse engineer, decompile, disassemble, scrape, or attempt to discover source code, models, prompts, API keys, or backend implementation details.
• Interfere with, overload, probe, or disrupt the app, backend, or connected services.
• Use automated systems to access the app or backend without permission.

9. Intellectual Property

The app, website, design, branding, characters, copy, code, features, and related content are owned by Mementum & Victus Inc. or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the app except as expressly allowed by these terms or applicable law.

10. Third-Party Services

TungMax AI relies on third-party services including Apple, ARKit, Cloudflare, OpenRouter and AI model providers, and Superwall. Your use of those services may be subject to their own terms, policies, and platform rules. We are not responsible for third-party service outages, policy changes, or platform decisions.

11. Termination

We may suspend, restrict, or terminate access to the app or related services at any time if you violate these terms, abuse the service, create risk for other users or the service, or if continued operation is no longer practical. You may stop using the app at any time and may delete it from your device.

12. Disclaimers

TungMax AI is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.

13. Limitation of Liability

To the fullest extent permitted by law, Mementum & Victus Inc. and its directors, officers, employees, contractors, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or service interruption arising from or related to your use of the app.

To the fullest extent permitted by law, our total liability for all claims related to the app will not exceed the greater of the amount you paid to use TungMax AI during the three months before the claim or fifty U.S. dollars (US $50).

14. Indemnification

You agree to defend, indemnify, and hold harmless Mementum & Victus Inc. and its directors, officers, employees, contractors, affiliates, and agents from claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the app, your content, your violation of these terms, or your violation of another person's rights.

15. Changes to the App or Terms

We may change, suspend, or discontinue features at any time. We may also update these terms. When we do, we will update the last updated date above. Your continued use of the app after changes become effective means you accept the updated terms.

16. Governing Law

These terms are governed by the laws of the United States and, where applicable, the laws of the state in which Mementum & Victus Inc. is organized, without regard to conflict of law principles.
